Scrap Metal Dealers Act 2013 Do you buy, sell or collect Scrap Metal?

The Scrap Metal Dealers Act 2013 will soon be coming into force in October 2013.

The new legislation will require that any persons collecting, buying or selling scrap will require a Scrap Metal Dealer Licence that will be issued by this council.
 

Even if you have an existing licence you will need to re-apply.
There will be a charge for this licence which is not known as yet??

There will be two types of licence:

A site licence
A collector’s licence

An application needs to be made for your licence and a fee will be payable to the Council. You will also need to submit a basic criminal record disclosure form no older than a month old as part of the application process.

Any persons who carry out business as a scrap metal dealer without a licence may be liable on conviction to maximum fine of £5,000. Your site licence will allow you to operate a site and collect any scrap relevant to that site.

Your collector’s licence will allow you to collect scrap only within the authority area that it was issued.

You will need to apply for collector’s licences from separate authorities should you wish to operate in more than one Council area.

Please note these do not replace the Waste Carrier’s Licence. To collect scrap in the Kirklees area you will be required to hold a licence issued by the relevant Council and a Waste Carriers Licence that is issued by the Environment Agency.

To ensure you can operate as a scrap metal dealer you will need submit a valid application with the correct documentation and fee between 1st & 15th October 2013.

Once they have received your valid application they will issue you a transitional licence that is valid until 1st December 2013, they will ensure you have your full licence by 1st December.

You are able to operate with your transitional licence, but please note your transitional licence will only be issued providing you complete a valid application between 1st and 15th October 2013.

We strongley recomend you act without delay once you recive the letter from your council.  We also sugest you hand deliver your application, fee and all subsiquent information and obtain a recite and reffernce number and contact details etc.

Please note they are unable to set the fee at this present time due to the Fees Guidance not having been issued by the relevant body. As soon as the fee is set they will update all information and if your details are registered with them they will email you up to date information.
